「民不與官鬥」是華人社會千年來的處世哲學，不過最高法院民事大法庭今年6月出爐一件裁判，顛覆了這「千年不敗」的觀念。大法庭認為，公務員故意違法造成人民經濟上損失，人民可以根據《國家賠償法》第2條第2項請求賠償，打破《國賠法》的法律條文隱晦不明的困境，也讓外界十分好奇，究竟是什麼案子，讓最高法院大法庭做出這個具有高度憲法意識的歷史性裁定。
